Information regarding the collection and processing of your personal information, in accordance with applicable laws in Quebec (Law 25) and Canada (PIPEDA).

We hereby inform you of our processing of your personal information and the rights conferred upon you. The nature and method of data use primarily depend on the services you have requested or that have been agreed upon with you.

2. What sources and data do we use?

We process personal information that we collect within the scope of our business relationship with you. This includes data provided by establishments (e.g., schools and daycares) for order processing, as well as data lawfully acquired from publicly accessible sources.

The data processed includes: identity and contact information (name, address, phone number, and email address), children's photos, and order data.

3. For what purpose do we process your data (processing objectives)?

3.1. To fulfill contractual obligations and process orders

Data processing is carried out to provide photography services and the associated sale of photos taken, including their production and shipping to customers. This includes order processing and customer relationship management.

3.2. As part of our legitimate interests

We process your data when necessary to safeguard our legitimate interests or those of third parties, such as: targeted advertising (unless you object); asserting legal claims; ensuring IT security; or for the evaluation and development of our services.

For photo sessions at events (non-school related), we process photos based on our legitimate interest. Individuals present are informed of the photo-taking and their right to object. A right to object only takes effect in the future. All processing carried out up to that point remains unaffected.

3.3. Based on your consent

If you have given us your consent to process personal data for specific purposes (e.g., publishing photos on social media or using testimonials), the legality of this processing is based on your consent. You may revoke any given consent at any time with future effect.

3.4. Based on legal provisions

We also process personal data to comply with our legal obligations, such as retaining invoicing data for tax and accounting purposes.

4. Who receives my data?

The departments that receive your data are those necessary to fulfill our contractual obligations. These are primarily GotPhoto and its subcontractors (photo product production, logistics, IT services, and payment). Data transmission outside of Clic & Craie only occurs if required by legal provisions or if you have given your consent.

5. How long is my data stored?

We retain your personal data to the extent necessary to fulfill our contractual obligations and to comply with legal retention requirements (tax and accounting deadlines). The duration of storage is also assessed in accordance with legal limitation periods in Quebec, which can vary from three to ten years.

6. What are your rights under Law 25 and PIPEDA?

You have the right to obtain information about the data we hold concerning you, to request its correction or deletion, and to request the limitation of its processing or its portability. You also have the right to file a complaint with the relevant supervisory authority (the Commission d'accès à l'information du Québec or the Office of the Privacy Commissioner of Canada).

7. Am I required to provide data?

You are only required to provide personal data that is necessary for the establishment, execution, and termination of the business relationship (e.g., delivery address, child's name for the gallery). Without this data, we cannot execute the contract or process the order.

8. Notifications and Alerts

When subscribing to email or SMS alerts (if available), the data provided is used exclusively for this purpose. You may revoke your consent at any time. Each alert contains an unsubscribe link, or you can notify your revocation by email to info@rebeccavandal.com. Revocation only takes effect in the future.

9. Third-party Provider Functions

9.1. Cookies

“Cookies” are text files stored on your computer to analyze your use of the website and improve your experience. The information generated by the cookie is transmitted to a server (often after IP anonymization) and stored.

We use cookies from the following third-party providers:

  • Google Analytics (for evaluating traffic and activities).
  • Google Adwords (for conversion tracking).
  • New Relic Inc. (for technical performance monitoring).
  • fotograf.de (related to GotPhoto).

You can prevent the storage of cookies by adjusting your browser settings, but this may reduce access to certain functions of this website.

9.2. Social Media Plug-ins

Social media plug-ins (links to Facebook, Instagram, etc.) may be used on our pages. To prevent unintended data transmission, we use a double-click solution (unless GotPhoto manages a different one). Data collected by the social network after activation is beyond our control. Please consult the privacy policies of the relevant social networks for more information.

Information about your right to object

In accordance with applicable laws, you have the right to object at any time to the processing of personal data concerning you on grounds relating to your particular situation, especially when the processing is based on our legitimate interests.

You have the right to object at any time to the processing of personal data concerning you for direct marketing purposes. If you object to processing for these purposes, we will no longer use your personal data for that purpose.
